These Terms of Service ("Terms") govern your access to and use of the Psycho Aesthetics website (trypsycho.com), including the one-time physique-and-potential analysis you can purchase there, and the Psycho Aesthetics mobile application (collectively, the "Service"), operated by Axel Sigmar, a sole proprietor doing business as Psycho Aesthetics ("we", "us", "our"). By purchasing, creating an account, or using the Service, you agree to be bound by these Terms.
You must be at least 18 years old to use the Service. By using the Service, you represent that you are 18 or older and have the legal capacity to enter into these Terms.
Through the website, Psycho Aesthetics offers a one-time physique-and-potential analysis: from the photos and measurements you submit, we produce a photographic render of your body at its genetic potential, a written analysis, and a training and nutrition protocol. The render and the written verdict are provided free of charge; the protocol is a paid one-time purchase, as set out in section 4. We also offer a separate Psycho Aesthetics iOS application. The Service is provided for your personal, non-commercial use.
To receive your website analysis you create an account secured by an email address and a password (set when you sign up, or at purchase, or when you claim your account afterward). You are responsible for maintaining the security of your credentials and for all activity under your account. You agree to provide accurate information and to keep it current. The separate iOS application uses Sign in with Apple.
The render and the verdict are free. You create an account, submit a front photo and your measurements, and receive your render at no charge. Side and back photos are optional and complete the four-angle set and your written verdict, also at no charge. No payment method is required for any of this.
Paid items. Two one-time purchases are offered, and neither is a subscription: there is no recurring charge and nothing auto-renews. The written protocol is $49.99 USD, offered from your dashboard after your render has been produced. The complete bundle is $97 USD, which includes the renders, the verdict, and the protocol in a single purchase up front. A retest is offered at $48.50 USD once twelve weeks have passed since delivery. Prices are those in effect at the time of purchase and may change; orders already placed keep the price they were charged. Payment is processed securely by Stripe; we do not store your full card details.
What you receive: your render lands on your dashboard within minutes of submission. Where a protocol has been purchased, it is reviewed by a person and delivered to your dashboard within seven days.
Refunds: if we are unable to produce something you have paid for, you are refunded in full to your original payment method. The free render and verdict involve no payment and therefore no refund. To request a refund or raise a problem with your order, contact us at privacy@psychoaesthetics.app.
The Service allows you to upload content, including photographs of yourself, voice recordings, and fitness data ("User Content"). You retain ownership of your User Content. By uploading User Content, you grant us a limited, non-exclusive, royalty-free license to process, store, and analyze your User Content solely for the purpose of providing the Service to you.

The Service uses artificial intelligence, including services provided by Anthropic, to analyze photographs, transcribe voice recordings, and generate coaching responses. AI analysis is inherently probabilistic and may produce inaccurate, incomplete, or inconsistent results. Body fat estimates, muscle development scores, and aesthetic assessments are approximations and should not be relied upon as medical or professional fitness assessments.
The Service does not provide medical, psychological, nutritional, or professional fitness advice. Information and recommendations provided through the Service, including by the AI coach, are for general informational purposes only. Always consult a qualified physician or licensed professional before beginning any new exercise program, changing your diet, or making decisions about your health. The Service is not a substitute for professional medical care.

The Service, including all software, text, graphics, logos, AI prompts, scoring algorithms, and other content (excluding User Content), is the exclusive property of Axel Sigmar and is protected by copyright, trademark, and other laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or for any other reason in our sole discretion. You may terminate your account at any time by canceling your subscription through Apple and contacting us to delete your data.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AXEL SIGMAR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
You agree to indemnify and hold harmless Axel Sigmar from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms.
Informal negotiation first. Before initiating arbitration, you and we agree to attempt to resolve any dispute informally by contacting each other in good faith for at least 30 days.
Binding arbitration. If the dispute is not resolved through informal negotiation, it shall be resolved through binding arbitration administered in Winnipeg, Manitoba, Canada, conducted in English by one (1) arbitrator. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
Class action waiver. You agree that disputes will be resolved on an individual basis only, not as part of any class or collective action.
These Terms shall be governed by and construed in accordance with the laws of the Province of Manitoba, Canada, without regard to its conflict of law principles.
If you believe any content on the Service infringes your copyright, please contact us at privacy@psychoaesthetics.app with the following: a description of the copyrighted work, the location of the allegedly infringing material, your contact information, and a statement under penalty of perjury that you are the copyright owner or authorized to act on their behalf.
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
This section applies only to the separate Psycho Aesthetics iOS application, which is offered on a subscription basis through Apple's In-App Purchase system and governed by Apple's applicable terms; it does not apply to the one-time website purchase. You acknowledge that these Terms are between you and Axel Sigmar only, and not with Apple Inc. ("Apple"). Apple is not responsible for the app or its content. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the applicable app subscription price if warranted. Apple has no other warranty obligation with respect to the app. Apple is a third-party beneficiary of these Terms with respect to the app and may enforce them against you.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the app and updating the "Last updated" date above. Continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
